Agencies accredited by the Children's Guardian to provide statutory out-of-home care services in NSW and are known as designated agencies. There are three types of accreditation:
- Provisional accreditation is for three years. Provisional accreditation is based on assessment of indirect evidence (policies and procedures) only and is applicable to agencies that have not made placements of children and young people in statutory out-of-home care during the 12 months prior to the application. When provisionally accredited agencies first make arrangements to provide statutory out-of-home care services, this is treated as application for full accreditation.
- Full accreditation can be for one, three or five years. Full accreditation is based on assessment of the agency’s indirect and direct evidence and is applicable to agencies seeking to renew their accreditation. Full accreditation is available only to applicants that can show current evidence relating to placements of children and young people in statutory out-of-home care.
Conditions of accreditation

Deferred accreditation decisions
Under Clause 47 of the Children and Young Persons (Care and Protection) Regulation 2012, the Children’s Guardian may defer a decision on an agency’s application for accreditation renewal. This may occur where an agency has not demonstrated minimum compliance with accreditation criteria before its accreditation expires.
Agencies may continue providing statutory out-of-home care services until a decision on renewal is finalised.
Allegations of serious misconduct
All agencies must notify the Children’s Guardian in writing each time an allegation of sexual misconduct or serious physical assault against a child or young person in statutory out-of-home care is received.

Children under 12 placed in residential care
All agencies must notify the Children’s Guardian in writing each time a child under 12 years of age is placed in residential statutory out-of-home care with the agency.
If the placement with the agency ceases before the child turns 12, the agency must notify the Children’s Guardian.
There is a form for agencies to notify the Children’s Guardian when a placement begins or ends.
