The following information is provided for authorised and exempt employers and parents regarding the legal requirements for employing children under the age of 15 years for entertainment, exhibition, still photography or door-to-door sales and under 16 years of age for any type of modelling.

The regulation includes the Code of Practice (Schedule 1). You can download it here.

Exempt and authorised employers must comply with the Code of Practice and give a copy of it to a parent of any child employed. It sets out all the things an employer of a child must do. A plain language explanation of the Code of Practice will be available shortly.

Please note: The Children and Young Persons (Care and Protection) (Child Employment) Regulation 2010 commenced on 1 September 2010.

Icon - Blue Application for Authority to Employ Children in NSW

Employers must be authorised by the Children's Guardian before employing children under 15 years of age for entertainment, exhibition, still photography and door-to-door sales, and children under 16 years of age for any type of modelling. Employers must apply on a prescribed form and pay a fee. Download the application form and contact our staff before you pay the fee. Contact details are at the bottom of this page.

Some employers may be exempt from the requirement to hold an Authority, however these employers must still contact the Children's Guardian to confirm entitlement to an exemption.

Please note: Version 3.4 was issued on 21 March 2012.  Text was amended on page 2 to ensure that employers do not make EFT payments until they receive written instructions confirming the correct fee and process, and to advise employers that they may submit scanned completed application forms via email..

Icon - Blue Pre-Employment Notification (PEN)

Contact our staff as soon as you identify that you might employ children under 15 years of age for entertainment, exhibition, still photography or door-to-door sales, or children under 16 years of age for any type of modelling, even if you have not selected them. We can provide information on the legislative requirements for employing children that may affect your planning. Contact details are at the bottom of this page.

Exempt and authorised employers must submit a PEN and other relevant pre-employment information to the Children's Guardian at least seven (7) days before employing any child. Lesser notice may be accepted by negotiation with the Children's Guardian, providing no additional welfare issues need to be resolved. You can download it here.
