Definitions

Here are the meanings of words and terms as defined in the Child Protection (Working With Children) Act 2012 and Child Protection (Working With Children) Regulation 2013. 

Adult 

A person who is 18 years of age or older.

Approved provider 

An approved provider under the Children (Education and Care Services) National Law (NSW) or the Children (Education and Care Services) Supplementary Provisions Act 2011.

Authorised carer

Has the same meaning as in the Children and Young Persons (Care and Protection) Act 1998:

  • the principal officer of a designated agency
  • a person who is authorised as an authorised carer by a designated agency
  • a person who is otherwise authorised as an authorised carer.

Certified supervisor    

A certified supervisor under the Children (Education and Care Services) National Law (NSW) or the Children (Education and Care Services) Supplementary Provisions Act 2011.

Children     

Persons under the age of 18 years.

Close relative

 A close relative of a person is:

  • a spouse or de facto partner of the person
  • a child, step-child, sibling, step-sibling, parent, step-parent, grandparent, step-grandparent, aunt, uncle, niece or nephew of the person
  • in the case of an Aboriginal person or a Torres Strait Islander, a person who is part of the extended family or kin of the person according to the indigenous kinship system of the person's culture.

Commercial basis  

A service is provided on a commercial basis if the service is provided on a fee for service basis, whether or not the fee concerned is imposed or funding for the service is obtained by a grant or other means.

Designated agency

 Has the same meaning as in the Children and Young Persons (Care and Protection) Act 1998.

 

Education and care service

An education and care service within the meaning of the Children (Education and Care Services) National Law (NSW) or a state regulated education and care service within the meaning of the Children (Education and Care Services) Supplementary Provisions Act 2011.

Employer

This means:  

  • a person who, in the course of business, arranges for the placement of a person in employment with others
  • a person who engages a person under a contract to perform work
  • a person who engages a worker to perform work as a volunteer for the person under an agreement (whether written or unwritten).

Home-stay

This is the residence with another family for a period of time, for the purposes of a cultural or educational program.

Parent  

Is the person having, in relation to the child, all the duties, powers, responsibilities and authority which, by law, parents have in relation to their children.

Worker

This means any person who is engaged in work:  

  • as an employee
  • as a self-employed person or as a contractor or subcontractor
  • as a volunteer
  • as a person undertaking practical training as part of an educational or vocational course (other than as a school student undertaking work experiences)
  • as a minister, priest, rabbi, mufti or other like religious leader or spiritual officer of a religion or other member of a religious organisation.
