Guidelines


The Office of the Children’s Guardian has prepared guidelines required by the Children and Young Persons (Care and Protection) Act 1998. These will enable designated agencies and authorised carers to fulfil their responsibilities under the legislation.

Authorised carers have the authority to make day-to-day decisions associated with the provision of care to a child or young person in out-of-home care. This authority is subject to any directions given by their designated agency and the Children’s Guardian.

Download Icon Guidelines for designated agencies for developing a behaviour management policy

Designated agencies must have a behaviour management policy in order to guide and inform authorised carers in the way they manage the behaviour of children and young persons in their care. Applications for accreditation and quality improvement must be accompanied by a copy of the agency’s own behaviour management policy.

The Children and Young Persons (Care and Protection) Act 1998 (the Act) addresses designated agency disclosure of information about the placement of a child or young person in out-of-home care to parents and other significant people. The Act requires designated agencies to have regard to the wishes of the child or young person, the authorised carer and these Guidelines when deciding on the amount and type of information to disclose.
